These terms apply when you register as an investor with Clarewood Capital Ltd, or receive details of any property from us by any route: website, email, deal pack, WhatsApp, phone or in person. You accept them by ticking the box when you register, or by asking for or using details of a property we send you.
In short: deal details are confidential, you don't go around us to the vendor or agent, and if you buy a property we introduced, our fee is payable.
Clarewood Capital Ltd, registered in England & Wales, company no. 15929482, 11 Chimney Walk, London E15 2TP. We find and introduce property investment opportunities to investors and are paid by the buyer. We don't give financial, investment, legal or tax advice. Do your own checks and take professional advice where you need it.
We introduce a property to you when we give you any of: a full or partial address or postcode, a listing link, financial details (price, rent, yield or returns), a deal pack, or any message about that specific property. This applies even if the property is also publicly advertised.
Keep everything we send you about a property confidential. Don't share it with anyone except your own professional advisers (such as your solicitor, broker or accountant), who must keep it confidential too, or where the law requires it.
Unless we agree in writing, you won't, directly or through anyone else:
This applies however you come across the property afterwards, and whether you act yourself or through a company, partner, nominee, family member or anyone acting for you ("associated parties").
If you or an associated party buy, agree to buy or secure an interest in a property we introduced, our fee is payable in full, even if the purchase went ahead without us. Our standard fee is on the Fees page and the fee for each property is confirmed in its deal pack or reservation form. Payment terms are in our reservation terms and conditions.
If you were already aware of a property before we introduced it, tell us in writing, with reasonable evidence, before asking for or receiving any more information about it. If you don't, we'll treat it as introduced by us.
These terms apply to each property for 24 months from the date we introduce it to you.
Emails, WhatsApp and other messages, our CRM records, documents and call records can all be used as evidence of an introduction.
If you break section 3 or 4, we can recover our full fee as if the purchase had gone through us, plus any other losses caused and our reasonable legal costs. Unpaid sums carry interest at 4% a year above the Bank of England base rate.
If you reserve a property, our reservation form and terms and conditions also apply. If you have signed a separate non-circumvention agreement with us, it applies alongside these terms.
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
